Fantasia Barrino: Lover's scorned wife appeals Alienation of Affection ruling



Fantasia Barrino’s judge should have recused herself from the the former American Idol winner’s obscure Alienation of Affection case, where an abandoned spouse can file a lawsuit against the person responsible for the collapse of their marriage, says the scorned wife of her former married lover, Antwaun Cook.

Paula Cook, has filed court documents appealing Judge Paige B. McThenia’s decision that she was separated from her husband at the time he started an affair with the singer and should have disqualified herself from the case because Fantasia's lawyers once represented the judge in her own divorce case.

She asserts that the Mecklenburg County, North Carolina Judge was represented by the law firm of Horack Talley, Barrino’s attorneys, in a past domestic action, and should have disqualified herself from the case.

Last month, the Judge ruled in favor of Paula’s ex-husband, Antwaun Cook, stating he was separated from his estranged wife at the time of his affair with Fantasia.

"Judge McThenia has unnecessarily intertwined the issues related to this case with the issues contained in the potential litigation between Plaintiff and Ms. Barrino,"Cook’s court filing reveals.

"As a result, it is impossible to ascertain whether her rulings are motivated by an impartial interpretation of the application law or a desire to influence the potential litigation in favor of Ms. Barrino."
